Welcome to Bikerverse! This End-User License Agreement ("Agreement") is a binding legal document between you and Bikerverse ("we," "us," or "our"), the provider of the Bikerverse mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the App and delete it from your device.
1. License Grant
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
2. User Accounts
To access most features of the App, you must register for an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Promptly notify us if you discover or otherwise suspect any security breaches related to the App.
You are responsible for all activities that occur under your account.
3. Acceptable Use
You agree not to use the App in any way that:
- Violates any applicable local, state, national, or international law or regulation.
- Is fraudulent, false, misleading, or deceptive.
- Infringes on the rights of others, including patents, trademarks, trade secrets, copyright, privacy, or other proprietary rights.
- Involves posting or transmitting any material that is defamatory, obscene, profane, or offensive.
- Could disable, overburden, damage, or impair the App or interfere with any other party's use of the App.
We reserve the right to terminate your access to the App for any violation of these acceptable use terms.
4. User-Generated Content
You are solely responsible for any content, such as bike listings, reviews, messages, and photos, that you upload, post, or transmit through the App ("User Content"). You retain all ownership rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your User Content in connection with operating and providing the App.
We are not responsible for the accuracy, completeness, or legality of User Content.
5. Subscriptions and Payments (If Applicable)
If the App includes features that require a subscription:
- Billing: Subscriptions may be billed on a recurring basis (e.g., monthly or yearly). You will be billed in advance on a recurring, periodic basis.
- Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your App Store (Apple App Store or Google Play Store) account settings.
- Fee Changes: We reserve the right to modify the subscription fees at any time. We will provide you with reasonable prior notice of any change in subscription fees.
6. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into this Agreement. Please review it to understand our practices regarding the collection and use of your personal information.
7. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach this Agreement. Upon termination, your right to use the App will immediately cease.
8. Disclaimer of Warranties
THE APP IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE APP.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR AFFILIATES HAVE ANY LIABILITY ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
10. Governing Law
This Agreement and your use of the App are governed by and construed in accordance with the laws of India. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
